Protecting the rights of military personnel: the government and the public are working on systemic solutions

The issue of strengthening the protection of military personnel's rights was discussed at an interdepartmental meeting hosted by Ukraine's Prosecutor General Andriy Kostin, which included representatives from the government, law enforcement agencies, and members of the public.

Deputy Minister of Defense of Ukraine Nataliia Kalmykova noted that most of the servicemembers’ complaints are related to the refusal to consider reports on referrals to military medical commissions (MMC), granting of vacations and payment of financial support. The Central Department for the Protection of the Rights of Servicemembers of the Ministry of Defense, which was established at the initiative of the Minister of Defense, has already considered almost a thousand appeals in three months of work.

"We have three major categories of appeals for the protection of servicemembers' rights. First and foremost, these are violations relating to the refusal to review and approve reports for referral to the National Security Agency, the granting of annual and family leave, the issuance of certificates of participant in hostilities, as well as non-compliance with the deadlines for their consideration. The second category is the payment of monetary support and additional remuneration both for participation in hostilities and payments to servicemembers who are undergoing in-hospital treatment because of injuries received. The third category is the relatives of servicemembers whose payments or compensations are hampered by official investigations into the deaths or injuries of their relatives," Deputy Minister of Defense Nataliia Kalmykova said.

The public and the Ministry of Defense have worked together to draft the required legislative amendments to address these issues and prevent such violations in the future.

The Deputy Minister of Defense also added that now it is necessary not only to strengthen the protection of the rights of servicemembers in these processes, but also to find systemic solutions that will prevent such violations in the future. To that end, the necessary changes to the law have already been drafted in collaboration with public sector representatives.

To avoid such incidents in the future, it is planned to clearly regulate the method for accessing official investigative materials to ensure that payments and compensations are processed on time. "The newly established Central Department for the Protection of Servicemembers' Rights responds to every request. Our task is to ensure that every soldier's legal rights are protected," noted Nataliia Kalmykova.

According to her, this step is an important component of a systemic approach to protecting the rights of servicemen and ensuring justice in all processes.
