MoD clarifies: How defense industry enterprises can apply for “Critical to the National Economy” status
The Ministry of Defence of Ukraine has approved criteria for designating enterprises operating in the defense industry, aircraft manufacturing, and space sector as critical to the national economy.
The decision was adopted by the Ministry of Defence Order No. 722 of October 28, 2025.
Clear criteria have been established to determine which enterprises may be recognized as critical to the national economy. This designation serves as the basis for reserving employees liable for military service during mobilization and wartime, in accordance with Cabinet of Ministers Resolution No. 76 dated January 27, 2023.
Applications and accompanying documents should be submitted to [email protected]. The email must be signed with a qualified electronic signature.
To ensure transparency and user convenience, the Ministry of Defence has developed detailed step-by-step algorithms for submitting applications, along with sample document templates provided below.
How to submit documents
OPTION 1
For state contract executors (up to 100% reservation)
Algorithm No. 1
1. Prepare the following information:
- Details of active state contracts under which the enterprise performs work or supplies defense-related products (Appendix 1);
- Details of the supply of defense products, execution of work, or provision of services for the most recent reporting period (Appendix 3).
2. Have the documents approved, signed, and stamped by the state customer.
3. Prepare a letter of application to the Ministry of Defence specifying:
- The EDRPOU code (Unified State Register of Enterprises and Organizations of Ukraine), legal address, and main business activities;
- The head’s full name and the enterprise’s contact details;
- The clauses of the Cabinet of Ministers Resolution No. 76 under which the enterprise is applying for critical status.
4. Attach to the letter the approved information and one of the following documents confirming financial activity:
- Statement of Financial Results (Form No. 2) or Report on Implementation of the Financial Plan (for state-owned enterprises);
- Or a report by the State Statistics Service on the production of industrial goods (Form No. 1-P or No. 1P-NPP).
Algorithm No. 2 – For subcontractors under state contracts
1. Prepare the following information:
- Details confirming participation in the execution of a state contract (Appendix 2);
- Details on the supply of defense-related products or services (Appendix 3).
2. Have the documents approved, signed, and stamped by both the main contractor and the state customer.
3. Submit a letter of application to the Ministry of Defence that specifies the enterprise’s EDRPOU code, contact details, business activities, and the applicable clauses of Cabinet of Ministers Resolution No. 76, and attach the approved documents.
4. Attach financial or statistical reports for the most recent reporting period (Form No. 2 or relevant statistical report).
OPTION 2
For enterprises operating in the defense industry, aircraft manufacturing, and space sector (up to 50% reservation)
Algorithm No. 3
1. Determine which three of the six criteria established by Ministry of Defence Order No. 722 the enterprise meets (e.g., participation in state contracts or programs, or production for the defense industry).
2. Prepare proof documents, such as:
- Statements or letters from the state customer, program implementer, or a defense industry enterprise;
- Copies of contracts or orders confirming participation in production or programs.
3. Have the documents approved, signed, and stamped by the relevant customer or enterprise.
4. Submit a letter of application to the Ministry of Defence specifying the enterprise’s EDRPOU code, contact details, description of activities, and the attached documents.
After reviewing the documents, the dedicated MoD working group decides whether the enterprise meets the criteria. This decision serves as the basis for subsequent employee reservations in accordance with Cabinet of Ministers Resolution No. 76.
