Military personnel may choose recipients for their financial allowances in case of captivity

Military personnel have been granted the right to designate who will receive their financial allowances in the event of captivity. To exercise this right, they must prepare a personal directive, certified by their commander or a notary, with the original document stored in the service member’s personnel file.

The Cabinet of Ministers of Ukraine has adopted a corresponding resolution today, developed by the Ministry of Defence of Ukraine.

This resolution refines the mechanism for disbursing service remuneration to military personnel captured, taken hostage, interned in neutral countries, or listed as missing in action.

The resolution establishes a clear payment mechanism, ensuring the preservation of entitled service remuneration for military personnel in such circumstances. Specifically, it grants service members the right to prepare a personal directive designating recipients of their funds. It also specifies the conditions for terminating payments, the procedure for submitting applications, and the list of required documents.

Additionally, the resolution clarifies the process for Territorial Recruitment and Social Support Centers (TRSSCs) to obtain information from state registers, simplifying the identification of individuals eligible for such payments.

It also specifies the timelines and procedures for submitting the original personal directive to military unit commanders, the conditions for its storage, and the provisions for its cancellation or amendment.

The resolution aligns with the provisions of the Law of Ukraine No. 3995-IX, dated October 8, 2024, and amends Government Resolutions No. 884, dated November 30, 2016, and No. 550, dated May 14, 2024.

To recap: Current legislation guarantees that service members who have been taken captive or held as hostages (excluding those who voluntarily surrendered), as well as those interned in neutral countries or reported missing in action, retain their entitlement to payments. These include the base salary corresponding to their last duty position, rank pay, and additional monthly service-related remuneration—such as increments to base salary, special allowances, bonuses, supplements, permanent rewards, and premiums—as well as one-time service-related payments, adjusted based on changes in length of service and applicable service remuneration standards.
