Department of Legal Support
The Legal Support Department of the Ministry of Defense of Ukraine deals with the legal aspects of the Ministry's interaction with state authorities, international organizations, and military formations. Its activities are aimed at protecting the legitimate interests of the Ministry of Defense, maintaining legal stability, and improving the regulatory framework in the defense sector.
Main tasks
- Organizing legal work aimed at the correct application, compliance with, and prevention of non-compliance with the requirements of Ukrainian legislation during the execution of the tasks and functions assigned to the Ministry of Defence of Ukraine, as well as representing the Ministry of Defence interests in courts and other jurisdictional bodies;
- Planning and coordinating the legislative and regulatory drafting work of the Ministry of Defence, based on the summarized practice of applying legislation on issues within the Ministry of Defence competence, and providing proposals to the Ministry's leadership regarding the improvement of legislative acts, acts of the President of Ukraine, and the Cabinet of Ministers of Ukraine for submission to the Cabinet of Ministers and the President of Ukraine in accordance with the established procedure;
- Carrying out legal work in the apparatus of the Ministry of Defence, as well as organizing legal work in territorial legal units, the Military Law Institute, and units and organizations directly subordinate to the Ministry of Defense, the Armed Forces of Ukraine, the State Special Transport Service, and state enterprises, institutions, and organizations under the Ministry's management;
- The Department manages its subordinate entities, including the Main Directorate of Military Justice (hereinafter referred to as the Main Directorate), the Military Law Institute of the Yaroslav Mudryi National Law University (hereinafter referred to as the Military Law Institute), and provides overall leadership to the legal services of the Ministry of Defence system.

En el marco de su mandato, el Ministerio de Defensa de Ucrania lleva a cabo actividades relacionadas con la implementación, aplicación y difusión de conocimientos sobre el Derecho Internacional Humanitario (DIH) en todo el sistema del Ministerio de Defensa.
Para consolidar y presentar estos esfuerzos, el Ministerio publicó su primer Informe Voluntario sobre el Derecho Internacional Humanitario, elaborado con el apoyo de la Sociedad de la Cruz Roja Ucraniana.
El Informe es detallado y exhaustivo, y abarca cuestiones clave del DIH a lo largo de seis secciones:

- El Sistema del Ministerio de Defensa: Competencias y Facultades en el Ámbito del DIH
- Protección de Categorías Específicas de Personas y Bienes
- Medios y Métodos de Guerra
- Difusión del DIH
- Garantizar el Cumplimiento del DIH: El Papel del Ministerio de Defensa
Lo que hace excepcional a este Informe es que documenta los procesos internos del Ministerio para respetar el DIH durante un conflicto armado internacional activo y de alta intensidad. Presenta numerosos ejemplos concretos de cómo el Ministerio de Defensa cumple con sus obligaciones: desde la protección de civiles —incluidos niños, mujeres y periodistas— hasta la regulación de los medios y métodos de guerra, la integración de tecnologías emergentes en consonancia con el DIH y la incorporación del DIH en la educación y formación militar.
